While Commander of the Jap Army Force in the Northern Celebes, including Talaud Islands, Sept 1944-Sept 1945 neglected to issue or enforce any or sufficient orders or instructions or to take steps to provide the treatment of PWs (according to the Hague Convention).
PWs include
23 Mar 45 at Talaud Islands - Hann Walters, King all RAAF
On or about 3 Mar 1945 at Kakaskasen Northern Celebes - Packham, Benson, Jones all RAAF
On or about 27 Jul 45 at Kaaten Northern Celebes - Orgill
On or about August 1945 at Kaaten, Northern Celebes - Hutton, Lockyer all RAAF.
Endo gave evidence and witnesses called on his behalf. He alleged he gave orders that PWs were to be treated with kindness and delegated his powers to officers under his command and assumed that they were being carried out.
JAG - The sentence of imprisonment raises a qn which will have to be decided. The Court had not the power, and did not, reduce the accused in rank and he still remains a Major-General of the Japanese Army. Necessary for him to be imprisoned in a separate place from other ranks. It is certainly one of the customs of war that officer PWs should not be detained in the same place as other ranks.
